The hospitalization contract is a pact that has emerged in doctrine, it is frequently analyzed by the Italian case law, but it is still unnamed in legislative regulation, although it appears to be presupposed by the medical liability laws and liability regime. It is precisely this condition that leads the legal scholar to examine the contract in question, to carry out an analysis that prescinds from concrete medical malpractices and thus identify the services that this contract includes, the guarantees it offers, but also detects its effects on third par ties, to trace a path for understanding next reforms.

Il contratto di spedalità costituisce un contratto emerso in dottrina, frequentemente analizzato dalla giurisprudenza, ma ancora innominato nella disciplina legislativa, ancorché presupposto dalle riforme e dal regime di responsabilità medica. Proprio tale condizione induce l’interprete a condurre un esame del contratto in discorso, al fine di realizzare un’analisi che prescinde da una concreta medical malpractice e individuare le prestazioni che tale contratto include, le garanzie che esso offre, i suoi effetti nei confronti di soggetti terzi e, così, meglio decifrare le prossime riforme.
