‘Non erit innocens malus’ Looking for Justice over maritime Crimes of International Concern . A tale of dichotomies

This dissertation is about dualities or dichotomies. In particular it investigates the interrelationships between two couple of dichotomies, the dichotomy between international and transnational crimes and the duality of land and sea as geographical and jurisdictional spaces in the attempt to answer the question of who does or should exercise its jus puniendi in case of maritime crimes of international concern.

Questa tesi tratta di dualità o dicotomie. In particolare, indaga le interrelazioni tra due coppie di dicotomie, quella tra crimini internazionali e transnazionali e quella tra terra e mare come spazi geografici e giurisdizionali, nel tentativo di rispondere alla domanda su chi eserciti o debba esercitare lo jus puniendi in caso di crimini marittimi di portata internazionale.
