Aldo Moro e l’insegnamento del diritto penale come “pedagogia democratica”. La dimensione costituzionale della dottrina morotea nelle Lezioni di Istituzioni di diritto e procedura penale

The book Lezioni di Istituzioni di diritto e procedura penale (Lectures on Institutions of Criminal Law and Procedure) collects the lectures held by Aldo Moro at the Political Science Faculty of the Rome La Sapienza University in the academic year 1975-1976. The Lectures clearly show the marks of the cultural environment of the time, in which Moro began to elaborate his own legal-philosophical and penalistic thought. Nevertheless, the work retains a certain scientific relevance. Not only does it fill a few significant gaps in the knowledge of Moro's thought (for example, his position on the traditional problem of punishment); but it also updates the analysis of some fundamental theoretical or political-criminal issues (such as, for example, the legal limits of the State's punitive power), in a more modern key, in the light of the principles of the Constitution of the Italian Republic.
