The article assesses the legal relevance of the economic condition of the responsible State in the determination of the amount of compensation due and its treatment by the ICJ in the decision of 9 February 2022 on reparations in the Armed Activities on the Territory of the Congo case (the Democratic Republic of the Congo v Uganda). The article analyses the previous international practice on this matter, the ICJ’s 2022 decision and the different hypotheses adopted to explain the legal relevance of the economic condition of the responsible State in the determination of the obligation of reparation or its fulfilment.
