The new scenario of connected and increasingly autonomous vehicles (hereinafter “CAV”), in addition to potential benefit for society, show a dark side. Reference is made to the variety of risks arising from information technology and satellite communication issues associated to “smart mobility”, some of them summarized in this paper (Par. 2). Thereafter, the essay will attempt to draw up some effective strategies to handle the risk beforehand, also on the basis of the resolutions coming from the practice under the Lex Mercatoria and according to available tools at an EU and International level (Par. 3). Finally, the essay will attempt, to the extent admissible by the relevant legal framework, to highlight the possible direction of liability rules for risks and damages originated by “smart mobility”, in a civil law system (Par. 4)
