The paper focuses on analyzing the main implications of immigration on criminal law systems in the West, with particular attention for the problematic matter of culturally motivated crimes in Italy and Europe more broadly. After a brief explanation of the main models of adaptation adopted in Europe (also known as assimilationist and multiculturalist models), the focus will be set upon the case of the Italian criminal system facing culturally oriented crimes. Within this macro-category of criminal activities, special attention will be given to female genital mutilations, as they are deemed to be an exemplar case of cultural felony.
Il presente lavoro si propone di ripercorrere le maggiori implicazioni del fenomeno immigratorio sul diritto penale italiano ed europeo, ponendo in risalto la problematica questione dei reati culturalmente motivati. Verranno brevemente esplorati i principali modelli di adattamento adottati a livello europeo (assimilazionista e multiculturalista) per poi analizzare il caso dell’Italia e le tecniche adoperate nel nostro ordinamento per rispondere al fenomeno dei reati culturalmente orientati. All’interno di questa macrocategoria un focus particolare sarà dedicato alle mutilazioni genitali femminili, quale caso esemplare di reato culturale.
