Migratory movements can be exceptional and unpredictable, requiring the use of extraordinary and urgent measures to prevent or supervise them. However, repressive policies have already been implemented in the past with similar modalities, with the result of preventing the entry of foreigners at the borders or of expelling those present on the territory. In these cases, the justification put forward was that the State must be able to use all tools to safeguard the common security, the collective welfare and the national economy. It may then be useful to verify whether in the history of Italian law there is a common thread between the provisions relating to refoulements currently in force and those issued at the time of the birth of the Italian Kingdom and in subsequent decades, given that the rules in force today have a historical antecedent in those of 1931.
I movimenti migratori possono assumere dimensioni eccezionali e imprevedibili, richiedendo l'uso di misure straordinarie e urgenti per prevenirli o controllarli. Più volte, in passato, sono state messe in atto politiche repressive con modalità spesso simili, con il risultato di impedire l'ingresso degli stranieri alle frontiere o di espellere quelli presenti sul territorio. In tutti questi casi la giustificazione addotta è stata che lo Stato dovrebbe essere in grado di poter ricorrere a tutte le misure indispensabili a salvaguardare la sicurezza comune, il benessere collettivo e l'economia nazionale. Può quindi essere utile verificare se nella storia del diritto italiano ci sia un filo conduttore che unisce le disposizioni in materia di respingimenti attualmente in vigore e quelle emanate al momento della nascita della del Regno d'Italia e poi nei decenni successivi, visto che le norme in vigore oggi hanno un antecedente storico in quelle del 1931.
