This essay summarizes how the Court of Justice of the European Union is effec- tively confronting the latest polish legal reforms that threaten judicial inde- pendence. The paper aims to highlight how such jurisprudence brought to the emergence of a European principle of judicial independence, based on both Article 19 of the Treaty on European Union and Article 47 of the Charter of Fundamental Rights of the European Union.
