The Authors present a review of rulings on the subject of transsexualism. They also illustrate some bills, with comparative notes. The desire to break free from the obligation of genital surgi- cal treatments emerges from the analysis of judgements. At the same time, the pathological con- notation of transsexualism is currently challenged on the scienti c front. If one day the opportu- nity to change the name and gender should be made independent from the surgical treatments, psychiatric forensic investigations will become even more relevant. At the same time, the loss of pathological connotation could endanger the guarantee of health care.
