The impact of the regulatory functions of area on the waste cycle: Some problems in terms of the perimeter of the entrustment, forms of service management and qualification of the waste The Author consider some aspects of the waste service, as a public service, depending on the introduction of the new functions of the Regulatory Authority for Energy Networks and the Environment. Above all, the identification of the activities included in the waste service is important to check the methods of assignment. In particular, the analysis focuses on the integrated management of waste, just to consider the service granted exclusively. The impact of the regulation is also considered on the existing way of manage the service, as it is necessary to take know an articulated situation in Italy and different realities. The different development of the plants is a factor that, according to the Author, will require a differentiated regulatory structure. The contribution look to the problem of the lack of an organic regulation on assimilated waste, due to the municipal level. It’s something that impacts on regulation, and ultimately on the market.

Il contributo intende considerare alcuni aspetti del servizio rifiuti, inquadrato come servizio pubblico, alla luce dell'introduzione delle nuove funzioni nel settore dell'Autorità di regolazione per Energia Reti e Ambiente. L'Autore considera anzitutto l'individuazione delle attività ricomprese nel servizio, ai fini della definizione del perimetro di affidamento a terzi. In particolare, l'analisi si centra sulla gestione integrata dei rifiuti, onde valutare gli ambiti del servizio concesso in cd. privativa. L'impatto della regolazione viene considerato altresì sulle gestioni esistenti, in quanto occorre tenere conto di un quadro articolato sul territorio nazionale e di realtà diversificate. Il diverso sviluppo degli impianti costituisce un fattore che, secondo la ricostruzione dell'Autore, necessiterà di un'articolazione regolatoria differenziata. Il contributo affronta poi il problema della mancanza di una disciplina organica sui rifiuti assimilati, in quanto la rimessione dei criteri per l'assimilazione dei rifiuti a livello comunale impatta sulla regolazione, e in definitiva sul mercato.
