Sovereignty represents the key concept of the modern State and 1648 is traditionally considered to be its date of birth. Nevertheless the birth process of the modern State is a much more complex phenomenon, to which the Lutheran Reformation made a major contribution. In particular, this paper will address two main issues from a legal-philosophical viewpoint: how the Lutheran Reformation superseded the Medieval model of sovereignty; how it was able to stabilize the constitutive elements of the Nation State, like the idea of a territory based legal system

Abstract
Sovereignty represents the key concept of the modern State and 1648 is traditionally considered to be its date of birth. Nevertheless the birth process of the modern State is a much more complex phenomenon, to which the Lutheran Reformation made a major contribution. In particular, this paper will address two main issues from a legal-philosophical viewpoint: how the Lutheran Reformation superseded the Medieval model of sovereignty; how it was able to stabilize the constitutive elements of the Nation State, like the idea of a territory based legal systemI documenti in IRIS sono protetti da copyright e tutti i diritti sono riservati, salvo diversa indicazione.
