La legislazione in tema d'ambiente è a una svolta

This essay aims at bringing up some points worth consideration regarding the scope and the general meaning of the recent constitutional reform which has assigned a subject such as protection of the environment, of the ecosystem and of the cultural heritage to the exclusive legislation of the state, and in doing so overturning a previous tendency, already fairly accepted at regulatory and jurisdictional level, which granted the protection of the environment to the competition between State and Regions. According however to the content of the new constitutional text, besides a section indeed related to the concept of environment and ecosystem protection, it's still possible identify the interest for the environment and its values as an horizontal and a crosswise goal, which cuts all legislative, normative and administrative competences, which can be identified at various governmental levels. The most relevant features appearing in the constitutional text of both profiles are then examined.
